1. Purpose

These Terms of Service (hereinafter "ToS") govern access to and use of the LinkHub service, a browser extension and web platform published by Incomparable OÜ (hereinafter "we", "our" or "LinkHub").

LinkHub is an independent tool designed to help users engage on professional social networks. It allows users to create personalized news feeds, generate AI-assisted comment suggestions, and access engagement statistics.

2. Acceptance of terms

By creating an account or using LinkHub, you agree to be bound by these ToS as well as our Privacy Policy. If you do not agree with these terms, please do not use our services.

We reserve the right to modify these ToS at any time. In the event of a substantial change, we will notify you by email or via a notification in the application. Continued use of the service after notification constitutes acceptance of the new terms.

3. Access conditions

• You must be at least 18 years old to use LinkHub.
• You must provide accurate and up-to-date information when registering.
• Use of the service must comply with applicable laws and the terms of use of third-party platforms with which LinkHub interacts.
• You are solely responsible for complying with LinkedIn's terms of use and those of any other platform on which you use LinkHub.

4. User accounts

• You are responsible for the confidentiality and security of your login credentials.
• You agree not to share your credentials with third parties.
• Any activity carried out from your account is deemed to have been performed by you.
• We reserve the right to suspend or delete an account in the event of fraudulent, abusive use or breach of these ToS, after prior notification except in case of emergency.

5. Free trial

LinkHub offers a 7-day free trial. To benefit from it, you must provide a valid payment method (credit card).

• No charge is made during the trial period.
• At the end of the 7 days, your subscription will be automatically activated and your payment method will be charged according to the chosen plan, unless you cancel before the end of the trial period.
• You can cancel your trial at any time from your user dashboard, free of charge.

6. Payments and subscriptions

Subscriptions are billed on a recurring basis (monthly or annually) according to the chosen plan. Payments are processed by our provider Stripe.

• Prices shown are inclusive of all taxes.
• You can cancel your subscription at any time from your user dashboard. Cancellation takes effect at the end of the current billing period.
• In the event of a plan change, the new rate applies from the next billing period.
• We reserve the right to modify our prices. Any change will be notified to you at least 30 days before it takes effect.

7. Right of withdrawal

In accordance with European Directive 2011/83/EU on consumer rights, you are in principle entitled to a 14-day right of withdrawal from the date of subscription.

However, by starting to use the service (including the free trial), you expressly acknowledge and agree that:

• The provision of the digital service begins immediately after your registration;
• You expressly waive your right of withdrawal from the moment you start using the service, in accordance with Article 16(m) of Directive 2011/83/EU.

This consent is explicitly obtained during registration via a dedicated checkbox.

8. Artificial intelligence and generated content

LinkHub uses artificial intelligence models to generate personalized comment suggestions. In this regard:

• AI-generated suggestions are proposals. You remain entirely free to use, modify or ignore them.
• You are solely responsible for the comments you publish, whether written by you or generated by the AI.
• LinkHub does not guarantee that AI-generated content is free from errors, suitable for every context or compliant with the specific rules of third-party platforms.
• The AI does not make any automated decisions about you, does not restrict your account and does not perform any scoring.

9. Intellectual property

All elements composing LinkHub (source code, design, texts, logos, algorithms, features) are protected by intellectual property law and remain the exclusive property of Incomparable OÜ.

• You may not copy, modify, distribute, resell or commercially exploit all or part of the service without prior written authorization.
• Use of the service does not grant you any intellectual property rights over it.
• Comments you write or publish via LinkHub remain your property.

10. Prohibited uses

It is prohibited to use LinkHub to:

• Publish unlawful, defamatory, hateful, harassing or discriminatory content.
• Massively automate interactions in violation of third-party platform terms of use.
• Impersonate a third party.
• Attempt to circumvent, disable or compromise the service's security measures.
• Use the service for spam or unsolicited commercial solicitation.

Any breach of these rules may result in the suspension or deletion of your account without notice or refund.

11. Limitation of liability

LinkHub is provided "as is". To the extent permitted by applicable law:

• We do not guarantee uninterrupted or error-free operation of the service.
• We shall not be held liable for indirect damages, data loss, loss of revenue or lost profits resulting from the use of or inability to use the service.
• Our total liability is limited to the amounts actually paid by you during the 12 months preceding the event giving rise to the claim.
• We are not responsible for actions taken by third-party platforms (including LinkedIn) against your account due to your use of the service.

12. Service availability

We strive to ensure optimal availability of the service. However:

• The service may be temporarily interrupted for maintenance, updates or in the event of force majeure.
• Interruptions or changes to third-party platform features (including LinkedIn) may affect the operation of LinkHub, without our liability being engaged.

13. Personal data

The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these ToS. We invite you to read it carefully.

14. Termination

14.1 Termination by the user

You can terminate your account at any time from your user dashboard or by contacting us by email. Termination takes effect at the end of the current billing period.

14.2 Termination by LinkHub

We may suspend or terminate your access to the service in the event of:

• Breach of these ToS;
• Fraudulent or abusive use of the service;
• Non-payment of amounts due;
• Request from a judicial or administrative authority.

Except in case of emergency or serious breach, we will notify you of the termination with reasonable notice.

15. Force majeure

We shall not be held liable for any delay or failure in the performance of our obligations resulting from a force majeure event, including but not limited to: natural disaster, pandemic, internet infrastructure failure, government decision, or any other unforeseeable, irresistible and external circumstance.

16. Applicable law and jurisdiction

These ToS are governed by Estonian law.

In the event of a dispute relating to the interpretation or performance of these ToS, the parties shall endeavor to find an amicable solution. Failing that, the dispute shall be submitted to the exclusive jurisdiction of the courts of Tallinn, Estonia.

17. Miscellaneous provisions

• If any clause of these ToS is declared null or unenforceable, the remaining clauses shall remain in force.
• Failure to exercise a right provided for in these ToS does not constitute a waiver of that right.
• These ToS constitute the entire agreement between you and Incomparable OÜ regarding the use of LinkHub.
